1. Acceptance of Terms

By accessing or using SyncList ("the App"), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, please do not use the service.

2. Eligibility

You must be at least 13 years old to use the Service. If you are under 18, you represent that you have your parent or guardian's permission to use the Service.

3. User Accounts

• You are responsible for maintaining the confidentiality of your account credentials.
• You are responsible for all activities that occur under your account.
• We reserve the right to suspend or terminate accounts that violate these terms or engage in abusive behavior.

4. Subscriptions and Pro Features

SyncList offers a "Pro" subscription that provides additional features and higher resource limits.

• Billing: Subscriptions are billed through your App Store or Play Store account.
• Resource Limits:
  • Free Users: Limited to 5 active lists, 50 items per list, and 2 groups.
  • Pro Users: Unlimited lists, items, and groups.
• Cancellations: You can cancel your subscription at any time through your device's subscription settings.
• Right of Withdrawal (EU/EEA/UK Consumers): Consumers in the EU, EEA, or UK have a 14-day statutory right to withdraw. For digital content/services, you agree that by initiating the download or access of Pro features, you lose your right once performance begins with your consent.

5. Acceptable Use

You agree not to use the App to:

• Violate any local, state, national, or international law.
• Attempt to bypass any security measures or resource limits.
• Interfere with or disrupt the service or servers.
• Attempt to gain unauthorized access to any part of the service.

6. User Content

You retain ownership of the data you input into SyncList. However, you grant us a worldwide, non-exclusive license to host, store, and sync your content solely for the purpose of providing the Service.

7. Intellectual Property

The App, including its original content, features, and functionality, is owned by SyncList and is protected by international copyright, trademark, and other intellectual property laws.

9. Dispute Resolution and Arbitration (USA Users)

Mandatory Arbitration: Disputes shall be settled by binding arbitration administered by the AAA under its Consumer Arbitration Rules.

Class Action Waiver: YOU AGREE THAT ANY CLAIMS WILL BE BROUGHT IN YOUR INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS PROCEEDING.

EU consumers can use the Online Dispute Resolution (ODR) platform: https://ec.europa.eu/consumers/odr

11. Governing Law

These Terms shall be governed by the laws of the State where the service provider is headquartered (US users) or your country of residence (EU consumers).

12. DMCA Policy (Copyright)

If you believe content infringes your copyright, please contact our agent at dmca@synclistapp.com with a description of the work and its location.

13. Changes to Terms

We reserve the right to modify these terms at any time. We will notify users of any significant changes via the App or email.
